McPHERSON, Kan. — The owners of a McPherson business raided in early October as part of a statewide enforcement operation by the Kansas Bureau of Investigation and the Kansas Attorney General’s office, have filed suit seeking injunctions against further such raids and return of property seized.
The suit was filed Dec. 9, 2025 in McPherson County District Court by Mike Ballinger, owner and operator of The Hanging Leaf at 106 South Main, and was filed as a class action by former US Attorney for Kansas Barry Grissom and Jake Miller of a Kansas City law firm.
The raids centered on claims by KBI Director Tony Mattavi and Attorney General Kris Kobach that the 15 businesses raided were selling hemp product with greater than 0.3 percent of Delta-9 THC.
The suit stated the testing done by the KBI, done by gas chromatography, was only able to detect the presence of THC and not the level of it. In this raid, seven thousand dollars in cash was seized along with product.
Also raising claims of vague constitutionality, the suit also asks raids be forbidden until the state adopts legal protection of products under 0.3 hemp derived from Delta-9 THC.
No hearing dates in the case have been set.
