LARNED, Kan. — The man charged with the shooting death of Dr. Tomas Garza south of Larned, was bound over arraignment following a preliminary hearing in Pawnee County District Court on Friday. Michael EG Reynolds of Larned is charged with second degree murder, aggravated assault with a deadly weapon and criminal possession of a firearm from the incident where he allegedly pointed a weapon at a second person.
Prior to the hearing, Reynolds’ attorney filed a Stand Your Ground immunity claim based on self-defense, but in binding him over Senior Judge Nancy Parish ruled prosecutors met their burden to overcome that claim, ruling evidence presented indicated Reynolds, not a reasonable person in these circumstances, could not have subjectively believed he needed to use deadly force against Dr. Garza.
Following the hearing a motion to reduce Garza’s $250,000 bond or allow him to be released on house arrest was denied by Judge Parish, who is hearing the case after District Judge Bruce Gatterman recused himself due to a possible conflict of interest. Reynolds’ Arraignment will be set at a later date.
