A Humboldt man has entered a no contest plea to a reduced charge of voluntary manslaughter in the March 8th shooting death of John Paul Kent during a disturbance outside his home.
The plea by Malachi Davis was entered as part of a plea agreement where no additional charges will be filed related to the case, and an amended compliant reducing the original second-degree murder charge.
In return, he agrees to a serve a mid-range sentence for a level 3 person felony, which the agreement anticipates will be 72 months less credit for time served since his arrest. He would also have to register as a violent officer for 15 years.
District Judge Daniel Creitz has ordered a pre-sentence investigation, with sentencing set for August 3rd at 9:30 AM.
Kent was shot after a a woman fled a house during a domestic dispute with Davis, who earlier reports indicated was the boyfriend that woman, had fled to a nearby residence, where Kent and Davis became involved in a verbal altercation, during which Kent was allegedly shot by Davis who was in his car at the time. Davis was captured later that evening after a traffic stop near La Harpe.
