McPherson City Commissioners Discuss Ongoing Dispute on North Myers Court; Public Works to Focus on Fixing Potholes

McPHERSON, Kan. — Ongoing issues were discussed related to a property in the 1300 block of North Myers Court at Tuesday’s McPherson Commission meeting. An ongoing dispute has been going on between a couple of property owners, and last Friday City Attorney Ann Elliott went to look over the situation.

In a report to the McPherson City Commission Tuesday, Elliott said there aren’t any violations currently, particularly at 1339 North Myers Court which has been the subject of complaints for some time. Although yard art and signs are on that property, none of them are infringing on the property of any neighbors. She did not check the backyard, which the city generally does not do, but there was nothing observed above the fence of the 1339 property. In that review, Elliott focused on two relevant sections of city code.

Elliott added any issues between the two parties will have to be dealt with through civil proceedings. She explained unless there is an obvious code violation, particularly under Chapter 50 of the code, there is nothing the city can do other than encourage the neighbors to get along and resolve their differences.

A prior City Attorney had done a similar examination of this property some years back and came to the same conclusion Elliott did in her inspection.

Commissioners did approve a $2129.50 payment to Rockworks for abatement of nuisances on a property at 323 Lucy Street. Code Enforcement officer Ryan Rank said a notification was sent to the owner of the property, who is in Florida, and no response was received or action taken. Along with weed and grass trimming, a haul-off dumpster was brought in to dispose of a considerable amount of trash in the backyard including tires.

With two major street projects concluding, Public Works Director Eric Duerksen told Commissioners crews will begin to focus on potholes. With just a few minor details to complete on reconstruction of Myers from 1st Street north to Hulse and the 1100 block of North Elm, Duerksen said crews will initially focus on asphalt streets first while the weather still allows for that, as they can still do concrete patching into the winter.

Also now complete is asphalt paving in the Sycamore subdivision, where few problems were encountered which Duerksen said surprised personnel from APAC Kansas, which did the work.

Work is also progressing on the Northview Road sidewalk projects and with concrete patching on West 1st, both of which are being impacted by repeated rain events.

Commissioners approved another change order on the Deerfield Estates South Sanitary Sewer project, reducing the contract with Prairie Landworks by about $320 reflecting final quantities used on the project.

Again, this year the McPherson Convention and Visitors Bureau had a presence at the Kansas State Fair, with a booth promoting McPherson and McPherson County. CVB director Joni Reigner told McPherson City Commissioners the booth this year featured a spin the wheel game with prizes and shared a lot of information about local attractions of all kinds. Reigner said they were busy throughout the fair, and the rain actually helped bring more people to their booth.

Commissioners approved a letter of support on behalf of Liberty Communities LLC which is seeking Kansas Housing Investor Tax Credits in connection with a project involving properties in the Barnstormers Field First Addition and Barnstormers West Field Subdivision, both located to the southeast of Avenue A and Maxwell.

The Commission also approved use of Lakeside Park in the Bandshell area for a Neon Nights event Saturday, Oct. 11 from 5-10 PM and proclamations were read for Emergency Preparedness Month and National Childhood Cancer Awareness Month.
