SCOTUS ruling likely handicaps EPA authority to regulate emissions

A Supreme Court ruling will handicap the Biden administration’s efforts to regulate greenhouse gas emissions.

In a 6-3 decision Thursday, the Court said EPA did not have clear direction from Congress to require power plants to shift from coal to cleaner energy sources as directed by the Obama-era Clean Power Plan that was repealed three years ago.

EPA administrator Michael Regan says while he’s deeply disappointed, his agency is committed to using its full scope of authorities to protect communities and reduce pollution that is driving climate change.
